The site is run by a guy down in Merthyr Tydfil who I have spoken with a couple of times

He's a great music lover and there's some very interesting stuff on there

I'll certainly be having a look

Hmmmm. Looks to me like there are some breaches of copyright there! Selling copies of BBC programming? Wonder what BBC World would have to say about that?

Colin, I remember Peta talking about this on the old R2 Messageboards

She was pumping me for information but at a very early stage I decided I didn't like her so I don't think I gave anything away

The only problem with the site is that it is prone to crashing because it just does not have the capacity for the number of users which is proof in itself that it's a great site Very Happy

I'm surprised she felt that it was down to her to investigate, to be honest, because the Beeb will be perfectly aware of what's going on. I bet it gets clamped on sooner or later.

I remember, a few years back, a CD from an up-coming-band which contained clips from their radio appearances - including the John Peel Show - and they were told to withdraw it by BBC lawyers because it contained segments of an interview by Mr. Peel himself. Oddly, they didn't seem bothered about the music which was recorded by the Beeb at the Maida Vale studios and therefore BBC copyright too.

The site has been there for more than five years and provides recordings of some shows which apparently the BBC cannot provide copies of because apparently in the 60s and early 70s the BBC was in the habit of broadcasting live output without having any record of the programme concerned which to me as a lawyer strikes me as complete madness

After all if some random person sues the BBC for defamation how on earth would they be able to defend the case?

I'm not sure I believe the official BBC line on this but people can make up their own minds

Either scripts/transcripts or - for unscripted shows - "logging recordings" have been retained for all broadcast output for many years, but such recordings haven't always been at broadcast specification. It was just too expensive an undertaking - especially for television.

I don't quite get what you mean by the above - but surely it's a simple "breach of copyright" issue, exacerbated by the fact that the site owner is actually requiring payment in exchange for copyrighted material?

Colin, what I'm saying is that the BBC claims it does not have recordings of shows broadcast around 40 years ago

However if someone sued the BBC for defamation based on something which was said on the BBC within the prescribed time limit for such action it would be very embarrasing for the BBC if they did not have a recording of the offending comment in order to prove their case

Strictly speaking they could ask the other party for disclosure of evidence but that would be embarrasing to say the least

Whilst I don't know whether recordings NOW exist of these programmes I simply do not believe that they were not made and retained for at least the statutory period for legal action because to do otherwise would be completely mad and if the BBC had any sense these copies ofshows could have been sold years later for a very good price

As I mentioned above, the corporation did, as a rule, keep what are called "logging copies"; these are low-quality copies usually recorded to 1/4" tape at 1 7/8ips speed (compared to full broadcast spec 15ips or even 30ips). Where programmes were scripted, these were retained instead. I've worked in broadcasting ops where all output has to be saved this way for at least 3 months in case a segment needs to be reviewed by the appropriate regulator. When I worked for a cable/satellite operator we used to be spot-checked by the IBA, as it was then, who would request a copy of a programme to be submitted by a certain date. They did it just to test compliance.

However, the BBC certainly didn't record the general run of radio programming at "broadcast" spec because of the cost of doing so (more than just the cost of 10" NAB tape spools). If such recordings exist, it's because the producing department covered such cost out of its budget.

Anyhow, the point I'm making is a different one. My question relates to the issue of Copyright. I cannot believe that the BBC is happy to see copies of its programming being offered FOR SALE outside its own control.

Alan Davis who runs Radio Rewind has permission from the BBC to sell copies of BBC programmes etc, etc. I have in the past been happy to help Radio Rewind with old Radio 1 material.
