My cousin's boyfriend was driving the train in question.
The BBC seem to have got the facts right as far as I understand them, however the likes of the Telegraph stated in their report that the train hit the car - not so, it was the other way around.
It's the third serious incident he's been involved in during the last eighteen months - one derailment south of Inverness that made the news, plus he hit someone trying to commit suicide on the line north of the city a few months ago. They succeeded.

In the year 2003/2004 there were 371 'work-related' fatal injuries to members of the public. That was about 1 person every day.
246 of these were as a result of suicide or trespass on railway premises.

Seems that those intent on suicide choose railway lines as an easy option. It's not so easy on the poor drivers, who have to live with the knowledge (and the memories of hitting these people) for years afterwards.
