|
|
Quote: | A Swindon motorist has 39 penalty points on his or her licence - the most in Great Britain - but not been banned.
A Freedom of Information request to the DVLA showed 638 drivers in Bristol, Dorset, Wiltshire, Somerset and Gloucestershire have 12 or more points. |

Could it be the persons points keep increasing because of outstanding court cases, and trying to stop them because of there hardship etc? Well that could be B****ocks, as the person keeps receiving these points due to bad driving. |

There's a much simpler explanation
The person concerned could have been convicted of multiple road traffic offences all at the same time which when the court aggregates the appropriate penalty points for each offence brings the total points to 39
The driver concerned could have argued that a ban would have resulted in severe hardship for a variety of reasons in which case the court could have exercised its discretion not to impose a ban
In that situation the driver could end up with 39 points but still be on the road
I'm not expressing a personal opinion on the merits or otherwise - I'm simply explaining how the situation can arise from my many years of legal experience _________________ Are you ready for a Ruddles? |

I'm pretty sure the guy who runs (ran?) BSM had more than 12 on his license.
Are all the points "live"? The report doesn't make it clear. _________________ Flickr |

If you have someone over the drink drive limit with 4 defective tyres driving with no valid road tax or insurance or MOT then those offences would attract at least 39 penalty points in total in one hit
Points remain on a licence for twelve months after they expire and even then they are not automatically removed and the licence holder has to request this and pay a fee which last time I checked was £19 _________________ Are you ready for a Ruddles? |
