It all depends on whether a court takes the view that the force used was reasonable and proportionate and every case is judged on its individual merits
There have been cases where burglars or intruders have been killed and where the courts have accepted that the force used was reasonable quite simply because the test of what is reasonable has to be applied subjectively based on an individual's state of mind at the time of being attacked or burgled
However it is unusual for the courts to sanction deadly force unless the perceived threat is very serious _________________ Are you ready for a Ruddles? |
